We offer a unique combination of expertise in administrative law, constitutional law and procurement law, allowing us to provide comprehensive advice and representation on a wide range of matters from regulatory compliance and constitutional matters to government contracting and procurement.
We review Supply Chain Management Processes and Policies against applicable legislation, from the Constitution, Public Finance Management Act and related Supply Chain Management Regulations, Directives and Instructions, as well as related bench-marking policies and procedures.
We advise, from various perspectives, on Public Sector Law, ranging from the Constitution, Public Finance Management Act and Related Regulations, such as Supply Chain Management Framework Regulations and related Directives and Circulars, Preferential Procurement Framework Act (“PFMA”), and Promotion of Administrative Justice Act. This includes advising on compliance with prescripts, including large scale and complex transactions with PFMA implications, particularly in respect to procedures to be followed to execute these transactions and the necessary Treasury Approvals required. Further, we conduct forensic investigations on projects which require compliance with the Constitution, PAJA, and PFMA and Client Internal Procedures. We also act in various High Court litigation matters relating to Supply Chain Management based on PFMA and Constitutional Requirements, including Promotion of Administrative Justice Act.
